ItaliaPass membership terms and conditions

The terms “ItaliaPass”, “we”, “us” or “our” refer to InterRail, LLC, an experienced tour operator that specializes in providing unique and memorable train and rail travel experiences in Italy. The term "you" or “guest” refers to any person who desires to purchase, or has purchased, our ItaliaPass membership (“ItaliaPass Primo”, "ItaliaPass Rome Companion"). Your purchase and use of the ItaliaPass membership is conditioned upon your acceptance, without modification, of all terms, conditions, policies and notices stated herein, as well as our Privacy Policy, available here, and incorporated herein by reference (collectively, “Terms and Conditions”). Please read these Terms and Conditions carefully, as they contain important information about limitations of liability and resolution of disputes through arbitration rather than in court. By purchasing or applying to purchase an ItaliaPass membership, or otherwise utilizing any of the Benefits, you agree to the Terms and Conditions outlined below. If you do not agree with these Terms and Conditions, you must not purchase an ItaliaPass membership and may not use the Benefits. Except for those benefits directly provided by ItaliaPass, all of the Benefits, products and other privileges made available to members of ItaliaPass are provided by third-party vendors and operators of the same (“Suppliers”), and are provided subject to the Suppliers’ terms and conditions, which are hereby incorporated by reference into these Terms and Conditions.

We reserve the right, in our sole discretion, to update, change or replace any part of these Terms and Conditions at any time, without notice. Such modifications shall be effective immediately. We will indicate the date that the Terms and Conditions were last updated at the beginning of the document. It is your responsibility to check our website or app periodically for changes. Your continued use of an ItaliaPass membership following the posting of any changes to these Terms and Conditions constitutes your acceptance of those changes.
Membership levels and pricing
The ItaliaPass Primo memberships are available at three price points:
- $99/year for all members of the public.
- $49/year for ItaliaRail customers with an ItaliaRail purchase over $100, without a RailAid membership.
- $30/year for ItaliaRail customers with an ItaliaRail purchase over $100, with a RailAid membership.
All ItaliaPass Primo memberships are valid for 1 year from the purchase date and are non-transferable and non-assignable, except as specifically noted below.
The ItaliaPass Rome Companion membership is available at one price point:
- $45/year for all membership of the public.

Refund and cancellation policy
Refunds are available within the first year of membership purchase, provided no benefits have been redeemed or otherwise utilized, or the value of redeemed or utilized benefits is less than the membership fee paid. If the total value of redeemed benefits exceeds your applicable membership fee (e.g., $99, $49, $45, or $30), no refund will be issued and your purchase of ItaliaPass shall be deemed NON-REFUNDABLE. Members will not be liable to pay the difference if benefits exceed the membership fee.
Your membership will automatically expire one (1) year from the date of membership purchase. Prior to the automatic expiration of your membership, we will send you a renewal notice where you may opt-in for us to automatically (without any further action from you) renew your ItaliaPass membership for another year, subject to any additional terms contained in said notice.
Refunds provided for benefits cannot be split between multiple purchases, and only apply once to each individual member. For example, the $50 ItaliaRail refund and $100 ItaliaTours refund must be applied entirely to purchases of at least $50 or more at ItaliaRail and at least $100 or more at ItaliaTours (and said ItaliaTour refund is applicable only to tours, not transfers). If more than one ItaliaPass member is included in the same purchase, each member can claim their respective refund. If the total purchase amount is less than the combined total refund, no credit will be issued for the remaining balance. For subsequent purchases, the $5 ItaliaRail refund and the 10% ItaliaTours refund apply per purchase, not per member. ItaliaPass rapid refunds cannot be combined with other promotional offers.
Rapid refunds can be applied to recent ItaliaRail and ItaliaTours purchases, even if the purchases were made before joining ItaliaPass. The refund applies to the most recent purchases, subject to the terms outlined in these conditions.
In the event you cancel your ItaliaPass membership (and failure to process a credit card payment shall be deemed a cancellation by you), said cancellation shall be effective as of the date we receive written notice of the same. You will be charged for any unauthorized access to, or use of, any ItaliaPass Benefits. Except as expressly described above, any sums received by ItaliaPass in connection with your ItaliaPass membership are NON-REFUNDABLE, and following the cancellation of your membership, ItaliaPass shall have no further liability, obligation or responsibility to you. In the event that your ItaliaPass membership has been revoked due to your payment card being cancelled, ItaliaPass reserves the right to pursue legal action to recover any outstanding charges.
ItaliaPass membership benefits
ItaliaPass members enjoy certain products, services, privileges and other benefits more particularly described here (collectively, “Benefits”). The Benefits applicable to your ItaliaPass subscription purchase are outlined in the ‘welcome email’ sent specifically to the email address you provided to ItaliaPass. Additional terms concerning the Benefits are as follows:
Refunds on ItaliaRail and ItaliaTours purchases:
- One-time $50 rapid refund on your first ItaliaRail order (minimum purchase $50). Not available for $49 or $30 members.
- $5 rapid refund on all subsequent ItaliaRail orders.
- One-time $100 rapid refund on your first ItaliaTours order (minimum purchase $100).
- 10% rapid refund on all subsequent ItaliaTours orders.
Hotel bookings:
- Access to wholesale pricing on hotels in Italy, with a 10% markup. Requires coordination with a Travel Experience Specialist to complete bookings.
Premium membership to Italy Magazine:
- Free 1-year membership to Italy Magazine.
Car rental rebate:
- $10 rebate on every ItaliaDrive car rental.
Free RailAid® trip protection:
- Valid for 1 year from the start of your first rail trip with ItaliaRail. RailAid coverage varies based on the membership start date. RailAid benefits apply to the primary ItaliaPass member and one additional traveler.
Dedicated Italy Experience specialist:
- Personalized travel support via primo@italiapass.com with priority responses.
WhatsApp support:
- Exclusive access to ItaliaPass WhatsApp support.
Exclusive lounge access:
- Access to the ItaliaPass Lounge at Rome’s Termini station with a pre-booking code.
Free priority access to Colosseum, Roman Forum, and Palatine Hill:
Redeemable for one free priority ticket.
Borgia Gallery access:
- Free entry to events at the Borgia Gallery.
Multiple members and refunds; use of, sharing and transferring benefits
Members may share unredeemed benefits (except the Italy Magazine membership and RailAid) with friends, family, or travel companions. The $50 rail refund and $100 tour refund are one-time use per year (by either the member or their traveling companion), but the $5 rail refund and 10% tour refund can be shared and used unlimited times within the membership period. Hotel and car rental benefits can also be shared multiple times during the membership period. Transferable benefits (i.e., the one-time $50 and $100 rapid refunds described above) must be sent to another person who signs up for ItaliaPass. At the time your ItaliaPass membership expires, any unused Benefits cannot be exchanged for other benefits. Each benefit is distinct and must be used as specified. ItaliaPass is designed for individual travelers and is not available to travel agents or individuals purchasing on behalf of multiple clients. The program is exclusively tailored for use in connection with an individual’s personal travel.
Disclaimers
ItaliaPass has been designed with care; however, ItaliaPass does not guarantee the accuracy or completeness of the information provided in connection with any product, service, rebate, or membership benefit. ItaliaPass may link to or reference other Suppliers, websites and services. ItaliaPass is not responsible for the content or performance of these Suppliers, external sites or third-party services. Except as expressly noted, the Benefits are owned and operated by independent third-party Suppliers. ItaliaPass members must abide by the rules and policies of each Supplier, and you agree and understand that the provision of certain Benefits does not guarantee access or continued access, and is subject to capacity restrictions. You agree that ItaliaPass has no control over the Supplier’s decision of whether to admit any person, the number of people allowed to partake in certain Benefits, the facilities offered, the opening/closing times, the length of time which you may engage in the Benefit, any charges payable in connection with the Benefit, or the personnel employed by Suppliers. ItaliaPass will use commercially reasonable efforts to ensure the Benefits and facilities are available as advertised, but you agree that ItaliaPass does not warrant nor guarantee the availability of, or Supplier’s performance in connection with, any Benefit. All Benefits and any tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each Supplier, and by accepting the coupons, vouchers, and tickets (if applicable), or utilizing the applicable Benefit, you agree that neither ItaliaPass, nor its employees, agents, or representatives, are or may be liable for any loss, injury, or damage to you, your guests, or your belongings, in connection with any of Benefit supplied or not supplied in connection with ItaliaPass, or otherwise resulting directly or indirectly from any occurrence beyond the control of ItaliaPass. ItaliaPass assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any guest that may result from any act or omission on the part of Suppliers or other third parties.
Changes to benefits and terms
ItaliaPass reserves the right to modify the terms, conditions, and benefits of the ItaliaPass membership at any time, without notice.
Intellectual property
ItaliaPass reserves all rights related to trademarks, logos, and proprietary content used in association with the ItaliaPass membership.
Notices
ItaliaPass may, but is not required to, notify you with respect to ItaliaPass or Benefits by sending you an email message to your membership email address or a letter via postal mail to your membership mailing address. Notices shall become effective immediately.
Use of your information
While we take reasonable steps to safeguard and prevent unauthorized access to your private information, we cannot be responsible for the acts of those who gain unauthorized access, and we make no warranty, express, implied, or otherwise, that it will prevent unauthorized access to your private information. IN NO EVENT SHALL ITALIARAIL OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES (WHETHER CONSEQUENTIAL, DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL OR OTHERWISE) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, A THIRD PARTY‘S UNAUTHORIZED ACCESS TO YOUR INFORMATION, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, STRICT LIABILITY, TORT OR OTHER THEORIES OF LIABILITY, AND ALSO REGARDLESS OF WHETHER ITALIARAIL WAS GIVEN ACTUAL OR CONSTRUCTIVE NOTICE THAT DAMAGES WERE POSSIBLE.
Force majeure
ItaliaPass assumes no liability or responsibility in connection with any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, cybersecurity issues and/or technology outages or disruptions, tropical storms or hurricanes, riots or civil commissions or disturbances, or any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics (such as COVID), or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel Supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by ItaliaPass that impacts negatively on, or hampers, its ability to operate the ItaliaPass membership program (collectively, “force majeure”). In the circumstances amounting to force majeure, we will not be required to refund any money to you.
Dispute resolution
YOU AGREE THAT ALL DISPUTES BETWEEN YOU AND US (WHETHER OR NOT SUCH DISPUTE INVOLVES A THIRD PARTY) WITH REGARD TO YOUR RELATIONSHIP WITH US, INCLUDING WITHOUT LIMITATION DISPUTES RELATED TO THESE TERMS AND CONDITIONS OR YOUR USE OF ITALIAPASS OR BENEFITS, AND/OR RIGHTS OF PRIVACY AND/OR PUBLICITY, WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION UNDER THE AMERICAN ARBITRATION ASSOCIATION’S RULES FOR ARBITRATION OF CONSUMER-RELATED DISPUTES AND YOU AND WE HEREBY EXPRESSLY WAIVE TRIAL BY JURY; PROVIDED, HOWEVER, THAT TO THE EXTENT THAT YOU HAVE IN ANY MANNER VIOLATED OR THREATENED TO VIOLATE OUR INTELLECTUAL PROPERTY RIGHTS, WE MAY SEEK INJUNCTIVE OR OTHER APPROPRIATE RELIEF IN ANY STATE OR FEDERAL COURT IN THE STATE OF MASSACHUSETTS. DISCOVERY AND RIGHTS TO APPEAL IN ARBITRATION ARE GENERALLY MORE LIMITED THAN IN A LAWSUIT, AND OTHER RIGHTS THAT YOU AND WE WOULD HAVE IN COURT MAY NOT BE AVAILABLE IN ARBITRATION.
A party who intends to seek arbitration must first send to the other, by certified mail, a written Notice of Intent to Arbitrate (“Notice”). The Notice to ItaliaPass should be addressed to: _______________________________ (“Arbitration Notice Address”). The Notice must (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought (“Demand”). If we do not reach an agreement to resolve the claim within 30 days after the Notice is received, you may commence an arbitration proceeding. You may bring claims only on your own behalf. Neither you nor we will participate in a class action or class-wide arbitration for any claims covered by this agreement to arbitrate. YOU ARE GIVING UP YOUR RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER ON ANY CLASS CLAIM YOU MAY HAVE AGAINST US INCLUDING ANY RIGHT TO CLASS ARBITRATION OR ANY CONSOLIDATION OF INDIVIDUAL ARBITRATIONS. You also agree not to participate in claims brought in a private attorney general or representative capacity, or consolidated claims involving another person, if we are a party to the proceeding. This dispute resolution provision will be governed by the Federal Arbitration Act and not by any state law concerning arbitration. Judgment on the award rendered by the arbitrator may be entered in any court having competent jurisdiction. Any provision of applicable law notwithstanding, the arbitrator will not have authority to award damages, remedies or awards that conflict with these Terms and Conditions. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, related to or connected with ItaliaPass or Benefits, or these Terms and Conditions, must be filed within one (1) year after such claim of action arose or be forever banned, and you acknowledge that this expressly limits the applicable statute of limitations of any claims that may be brought against ItaliaPass to one (1) year.
Limitation on liability; cap on damages
YOUR USE OF ITALIAPASS OR ANY BENEFITS IS AT YOUR OWN RISK. YOU AGREE THAT ITALIARAIL IS NOT LIABLE OR RESPONSIBLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE WHICH MAY ARISE OUT OF YOUR USE OF ITALIAPASS. ITALIARAIL HEREBY DISCLAIMS ANY LIABILITY AND THIS LIMITATION APPLIES TO ALL CLAIMS OR CAUSES OF ACTION IN THE AGGREGATE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES, IN CONNECTION WITH ITALIPASS OR ANY BENEFITS, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILFULL ACTS, OMISSIONS OR OTHERWISE OF ANY SUPPLIER, OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR CANCELLATION AND REFUND POLICIES, BANKRUPTCY OR CESSATION OF OPERATIONS, OR OTHER MATTERS OUTSIDE OF ITALIARAIL’S CONTROL, AND YOU HEREBY EXONERATE AND FULLY RELEASE ITALIARAIL FROM ANY LIABILITY WITH RESPECT TO THE SAME. NOTWITHSTANDING ANYTHING HEREIN TO THE CONTRARY, YOU UNDERSTAND THAT ANY RECOVERY FROM ITALIARAIL WILL BE LIMITED TO THE AMOUNT OF FEES ACTUALLY RECEIVED BY ITALIARAIL IN CONNECTION WITH YOUR ITALIAPASS MEMBERSHIP. THIS SECTION SHALL SURVIVE ANY TERMINATION OR CANCELLATION OF THESE TERMS AND CONDITIONS, WHETHER BY OPERATION OF LAW OR OTHERWISE.
Indemnification
You and your guests are expected to act responsibly and adhere to all behavior guidelines, polices and rules established by ItaliaPass and our Suppliers. We reserve the right to remove you from the Lounge if you violate, or threaten to violate, any provision of these Terms and Conditions, in our sole discretion, and in such a case, there will be no refunds. You and your guests agree to and shall indemnify, defend, release and hold harmless ItaliaPass and its employees, shareholders, agents, and representatives, from and against any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by ItaliaPass (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) your or your guests’ breach or violation, or threatened breach or violation, of these Terms and Conditions; (ii) any damage or destruction arising out of your access and, or your engagement with or use of ItaliaPass or Benefits, (iii) any force majeure or inherent risk of travel; or (iv) claims brought by third parties in connection with any of the foregoing. The terms of this Indemnification paragraph shall survive any termination or cancellation of these Terms and Conditions, whether by operation of law or otherwise.
Miscellaneous
These Terms and Conditions constitute the entire agreement between you and ItaliaPass with respect to and governing your use of ItaliaPass superseding any prior agreements between you and ItaliaPass concerning the ItaliaPass membership or Benefits. If any part of this agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of these Terms and Conditions, and the remaining portions shall remain in full force and effect. ItaliaPass’ failure to enforce any right or provision in these Terms and Conditions shall not constitute a waiver of such or any other provisions. ItaliaPass shall not be responsible for failures to fulfill any obligations due to causes beyond its control. The provisions of these Terms and Conditions which by their nature extend beyond termination or cancellation of these Terms and Conditions shall survive the expiration or termination of these Terms and Conditions to the fullest extent necessary for their enforcement and for the protection of the party in whose favor they operate.
